This Privacy Policy explains how DataRunner LLC (“DataRunner,” “we,” “us,” or “our”) collects, uses, and shares information when you use our platform, website, and municipal lien search services. It is incorporated into and part of our Terms and Conditions.

1. Introduction

This Privacy Policy explains how DataRunner LLC (“DataRunner,” “we,” “us,” or “our”) collects, uses, and shares information when you use the DataRunner platform, website, and municipal lien search services (together, the “Services”). It applies to our website visitors, account holders, and users across all of our audiences, including title agents, attorneys, lien search providers, individuals, and business customers.

The Services are intended for users in the United States and are operated from the United States. By using the Services, you agree to this Privacy Policy. This Privacy Policy is incorporated into and part of our Terms and Conditions. Terms we capitalize but don't define here have the meaning given in the Terms and Conditions.

2. Information we collect

We collect only the information we need to provide and operate the Services. This falls into a few categories.

Information you provide to us. This includes information you give us when you create an account, request or place an order, or communicate with us, such as your name, business or organization name, email address, and the account or role information used to set up and verify your access. When you place an order, we collect the property and transaction details needed to perform the search you request.

Payment information.How your payment information is handled depends on your payment method. For card payments, our third-party payment processor, Stripe, collects and processes your card details to complete the transaction; we do not store full payment card numbers ourselves, and Stripe's handling of your information is governed by its own privacy policy. For customers who pay by ACH or bank transfer under an invoicing arrangement, we collect the billing and banking information needed to process those payments and manage your account. In all cases, we receive the information needed to confirm payment and manage your orders and account.

Information we collect automatically. When you use the Services, we and our analytics providers automatically collect certain technical and usage information, such as your device and browser type, IP address, pages viewed, links clicked, and how you navigate and interact with our website. We describe the tools we use and your choices in the “Cookies, analytics, and tracking” section below.

Information from third parties. We may receive information from the third-party and governmental sources we use to perform searches, and from service providers who help us operate the Services, such as our payment processor. We do not purchase personal information for marketing purposes.

3. How we use your information

We use the information we collect to:

  • provide, operate, and deliver the Services, including performing the municipal lien searches you request and delivering results and documentation;
  • process payments and manage your orders and account;
  • verify accounts and roles, and communicate with you about your account, orders, and support requests;
  • contact you about your account, orders, and our Services, including by phone, such as when our team follows up with you or checks in about your orders or how the Services are working for you;
  • send transactional messages you need, such as order confirmations, receipts, and account, security, and legal notices;
  • send marketing communications where you have opted in, and only until you opt out (see “Your privacy choices” below);
  • understand how the Services are used so we can maintain, improve, and develop our services and offerings, including troubleshooting, analyzing usage and demand, and planning new features and coverage;
  • protect the security and integrity of the Services, prevent fraud and misuse, and enforce our Terms; and
  • comply with our legal obligations.

We do not use the personal information in your orders to train or develop the search or artificial intelligence models that power our search technology.

4. How we share information

We do not sell your personal information for money, and we do not share the contents of your searches or your account information with third parties for their own marketing.

We share information only in these situations:

Service providers. We share information with companies that help us operate the Services, such as our payment processor (Stripe), hosting and infrastructure providers, analytics providers, and communication tools. They may use the information only to provide services to us.

Governmental and record sources. To perform the searches you request, we interact with municipal, county, governmental, and other third-party record sources. The property and order information needed to conduct a search may be submitted to or through these sources.

Advertising partners.We work with advertising partners, currently LinkedIn, that may collect information about your activity on our website through cookies and similar technologies in order to show you DataRunner advertisements on their platforms. This activity may be considered “targeted advertising” or “sharing” under some privacy laws. You can opt out as described in “Your privacy choices” below.

Legal and safety. We may disclose information if required by law, regulation, legal process, or governmental request, or where we believe disclosure is necessary to protect our rights, enforce our Terms, prevent fraud or harm, or ensure the security of the Services.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to this Privacy Policy.

5. Cookies, analytics, and tracking

We and our providers use cookies and similar technologies to operate the Services, understand how they are used, and support our advertising. These fall into the following categories:

Essential. Cookies necessary for the website and Services to function, such as keeping you logged in and maintaining security. These are always active.

Analytics. We use Google Analytics to understand how visitors find and use our website, such as which pages are viewed and how people navigate, so we can improve the Services. This information is generally aggregated and used for statistical purposes.

Behavioral and session analytics. We use Contentsquare to understand how users interact with our website. This may include recording and reproducing your interactions with our pages, such as mouse movements, clicks, scrolling, and navigation, in the form of session replays and heatmaps. We use this to diagnose problems, improve usability, and enhance the Services. This information is used to understand site experience, not to identify you personally.

Advertising.We use the LinkedIn Insight Tag to understand visits to our website and to show you DataRunner advertisements on LinkedIn. This involves sharing website-usage information with LinkedIn for targeted advertising. You can opt out of targeted advertising as described in “Your privacy choices.”

6. Your privacy choices

Marketing emails. We send marketing emails only to people who have opted in. You can opt out anytime through your account settings or the unsubscribe link in any marketing email. Opting out does not stop transactional messages you need, such as order confirmations, receipts, and account, security, and legal notices.

Targeted advertising.We work with advertising partners, currently LinkedIn, that collect information about your activity on our website to show you DataRunner ads on their platforms. This may be considered “targeted advertising” or “sharing” under some state privacy laws. You can opt out through your account settings or by contacting us. We are working to expand the ways you can manage these preferences.

Cookies. You can manage or disable non-essential cookies through your browser settings. Essential cookies are required for the Services to function.

Account information. You can review and update your account information by logging in or by contacting us.

7. State privacy rights

Depending on your U.S. state of residence, you may have rights regarding your personal information, including in states such as Florida and California and additional states as their laws take effect. Subject to the limits and exceptions in applicable law, these may include:

  • Access: to know whether we process your personal information and to request a copy.
  • Correction: to request that we correct inaccurate information.
  • Deletion: to request that we delete your information.
  • Opt out:to opt out of targeted advertising or the “sale” or “sharing” of your information as defined by your state's law.
  • Non-discrimination: not to be treated differently for exercising these rights.

How to exercise your rights. You can make a request through your account settings or by contacting us. We may need to verify your identity before responding. If an authorized agent makes a request on your behalf, we may ask for proof of authority.

Appeals. If we decline your request, you may appeal by contacting us, and we will respond within the time required by applicable law.

8. Data retention

We keep your information for as long as your account is active and as long as we need it to provide the Services. After that, we retain information for the period necessary to comply with our legal, tax, accounting, and recordkeeping obligations, to resolve disputes, and to enforce our agreements. Retention periods vary depending on the type of information and the requirements that apply to it, including requirements related to real estate and title records. When we no longer need information, we delete it or de-identify it so it can no longer be associated with you.

9. Security

We use administrative, technical, and physical safeguards designed to protect your information, including measures such as encryption of data in transit, access controls, authentication requirements, and monitoring of our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for notifying us if you believe your account has been compromised.

10. Children's privacy

The Services are intended for businesses and adults and are not directed to children. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete it. If you believe a child has provided us with personal information, please contact us.

11. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated policy with a new “Last updated” date and take other reasonable steps to notify you where appropriate. Changes are effective when posted unless we state otherwise. Your continued use of the Services after the changes take effect means you accept the updated policy.
